I, the undersigned, being of sound mind and body, on my own behalf and on behalf of my heirs, estate and personal representatives, and in consideration for my voluntary participation as a volunteer, do hereby declare and agree as follows:

I wish to participate as an unpaid volunteer.

I understand and agree that the City of Carmel (“City”) or I may, at any time and for any reason, terminate this Agreement, without cost or liability, and that if I am asked by the City to cease my involvement as a volunteer, I will do so immediately.

I understand and agree that, as a civilian volunteer, I have no police powers. I understand and agree that I have no rights or protections beyond those enjoyed by all citizens of the United States and that I am fully responsible for my conduct, and that I will, at all times while volunteering, conform my comments and actions to what is permissible under applicable law.

I understand and agree that by its very nature, volunteering may involve a degree of risk from a variety of sources which could result in damage to my property and/or my serious bodily injury, and that, being fully advised and aware of same, assume and accept full responsibility for any risk that may result from my volunteer participation.

I release and promise not to sue the City and its employees, agents, sponsors, officers, and officials from and for any liability for any claims, losses, damages, bodily injuries (including death), property damage, and all other injuries, claims or misfortunes whatsoever that are or may be sustained by or to me or any other person or property as a result of my volunteer participation.

I agree to hold harmless the City and its employees, agents, sponsors, officers, and officials from and against any and all claims, losses, liabilities, expenses (including attorney fees), costs and damages, however occurring, from and for any loss, injury (including death) and/or damage of or to any person or property resulting from or claimed to be a result of any conduct or act taken or omitted by me or at my direction while or as a result of my volunteer participation.

I agree to allow the City to assist me by administering basic first aid if needed (e.g., ice packs, band-aids, etc.).

I hereby consent to the publication and use of my likeness for the purpose of promotion, publicity, or other manner or media by the City, its employees, agents, sponsors, officers and officials. Likeness shall include, but not be limited to, photographs, sound, and/or video recordings. I understand that these materials may be used in various forms of media such as , promotional materials, websites, and social media platforms. I hereby waive any rights of compensation or ownership thereto.

I have carefully and completely read and fully understand this Volunteer Liability Waiver and Media Release Agreement, and sign the same voluntarily, knowingly and of my own free will.
